DELTA confessed its guilt by its own words.
When Delta was asked by the plaintiff in the lawsuit:
"If I had never sought recovery of the money taken from me 'in error,' what would have happened to that money,?"
Attorney for DELTA, Phil Atkins-Pattenson, Esq., of the firm of SHEPPARD-MULLIN in San Francosco, California, responded as follows:
"Delta does not do a reconciliation of (sic) a passenger-by-passenger basis, but in general, if you had never requested a refund, then after the deadline for the refund request on your ticket had expired, Delta would eventually have recognized this $21.01 as a miscellaneous revenue."
In other words: DELTA WOULD KEEP THE MONEY IT TOOK FROM ME FOR THE FM-T VISA WHEN IT KNEW I WAS EXEMPT.
