You don't have to be a rocket scientist or a genius to figure out this scam, just read the Airline Deregulation Act of 1978, find out some facts and apply what you know.
So here is what we know or can easily find out. These are the details that make this scam so sweet for Delta.
Mexico imposes a fee on every visitor/tourist coming into Mexico for up to 180-days. This fee buys the tourist a visa (called an FM-T).
To make bookkeeping easier for everyone, the airlines collect the fee for the FM-T from each passenger getting a round-trip ticket from outside of Mexico where they go to Mexico and then leave. So the fee is now part of the fare Delta charges.
Under a deal with the Mexican Government, a record is kept of how many FM-T visas are issued to Delta passengers, and at some point, Delta pays the Mexican Government the fee it collected. So far, so good.
But here is the catch that Delta loves: Under Mexican law, the same law that says all tourists must pay for an FM-T, there is a section, well known to Delta, that says certain persons are exempt from having to pay the FM-T fee. These persons include Mexican citizens and non-Mexicans who hold residence papers allowing them to live in and come and go out of and into Mexico without an FM-T. These exempt people hold Mexican visas called FM-2 and FM-3.
Even though Delta has absolute knowledge of the fact that literally tens of thousands of exempt persons buy tickets to Mexico, including Mexican citizens, Delta has refused to do anything to let these people know that they are or may be exempt from paying for the FM-T.
In none of its print ads respecting its Mexico flights, does Delta mention there are persons exempt from having to pay for the FM-T.

At no place and at no time does Delta make any effort to let people know that they may be exempt from having to pay the fee for the FM-T. NADA!
Instead of being fair to its passengers, Delta takes money from exempt persons and pockets it.
Under the Deregulation Act, if you know as a fact, Delta lied to you and took money under false pretenses, you will get bounced out of court quickly. You will also find there is no other avenue open to you. Why?

THE SHORT VERSION:
Delta puts the approximately $21 fee for the Mexican Tourist Visa into every ticket to Mexico. On the plane, Tourist Visa applications are passed out. Tourists fill them in and turn them into Immigration and get the Tourist Visa. Mexicans and others who don't need the Tourist Visa enter on their own papers. Delta pays Mexico for the Tourist Visas issued and pockets the rest of the money. End story.
Delta has added one more part to its scam you should know about.
If an exempt person continues to complain to Delta trying to get their money back, Delta may send a voucher to that victim that can only be used for travel on Delta. This was done to one passenger in March, 2008, and she received a Delta voucher for US$21.83 that expired 9-months later. Of course, Delta ignores the fact the victim of the scam paid cash for the improperly collected fee, and a voucher does the victim no good if they do not intend to fly Delta again before it expires.
