Complaint against Delta Air Line

Dear Secretary:

It has come to my attention that Delta Air Line has for many years been engaged in an unfair and deceptive practice and that DOT has done nothing about it.

Specifically, Delta has been collecting a fee from all passengers imposed by the Mexican government on visitors for a Tourist Visa known as the FM-3.

Delta has for many years had actual knowledge that Mexican citizens and persons other than Mexicans legally loving in Mexico and holding FM-2 and FM-3 visas are exempt from having to pay for an FM-T.

Delta demands that these exempt persons pay the fee for the FM-T alleging it is required by and will be paid to the Mexican Government. In fact, Delta simply pockets the money collected for the FM-T visa from the exempt persons. If someone complains and tries to get the money back through the courts, Delta hides behind the preemption provision of the Airline Deregulation Act of 1978 and the matter is thrown out.

As a taxpayer, I request you investigate this situation under authority of Title 49, subtitle VII, Part A, subpart ii, Chapter 417, subchapter 1, section 41712(a) of the United States Code and order Delta to cease and desist such deceptive conduct. I also believe Delta should be penalized in the amount it has deceptively taken and retained from exempt passengers.
